VILLAWIN SOCIAL MEDIA GIVEAWAY TERMS

1. ABOUT THESE TERMS

1.1 These terms (the "Giveaway Terms") apply to the free promotional giveaways that we run from time to time on the VillaWin social media accounts (each a "Giveaway"). The promoter is Via del Premio Limited, a company incorporated in Gibraltar (company number 126740) with registered office at Madison Building, Midtown, Queensway, Gibraltar, GX11 1AA ("we", "us", "our"). You can contact us, including with any question or complaint about a Giveaway, by email at support@villawin.co.uk.

1.2 Each Giveaway is announced in a post, story or video on one of our social media accounts (the "Post"). The Post states the details specific to that Giveaway, such as the prize, the actions required to enter, the closing date and time, the number of winners and any additional conditions (the "Post Details").

1.3 Giveaways are free to enter. No purchase or payment of any kind is required to enter, to win or to receive a prize.

1.4 Each Giveaway is organised by us alone and is in no way sponsored, endorsed or administered by, or associated with, the social media service on which the Post is published or its operator (the "Platform"). By entering, you release the Platform and its affiliates from all liability in connection with the Giveaway, to the fullest extent permitted by law. Questions about a Giveaway must be directed to us and not to the Platform.

2. ENTERING

2.1 You must be at least 18 (eighteen) years old to enter. We may ask a winner for proof of age and identity before awarding a prize, and may withhold the prize if it is not provided or if we reasonably believe that the winner is under 18 (eighteen).

2.2 Giveaways are open only to persons whose legal permanent residence is in the United Kingdom. No employee, officer, director, consultant, contractor or agent of Aston Villa Football Club Limited, Aston Villa Women’s Football Club Limited or Aston Villa Foundation, or of us or of any company within our group, nor any member of their household, may enter or participate in any Giveaway, whether directly or indirectly. Any entry made in breach of this clause is invalid.

2.3 You must enter in your own name, using your own genuine personal account on the Platform. Entries made by automated means, from more than one account by the same person, from accounts created or used mainly to enter giveaways, or on behalf of another person are not valid. Unless the Post Details say otherwise, each person may enter once.

2.4 To enter, complete the actions stated in the Post before the closing date and time stated in the Post (United Kingdom time). Only those actions count. Anything the Post describes as optional is not a condition of entry and does not affect your chances of winning. Where the Post invites you to tag other people, tag only people you know, and only in content in which they appear. Your entry must be visible to us: if your account is private or your interaction cannot be seen or verified by us, we may be unable to count it. Entries not recorded by the Platform before the closing time, for whatever reason, are not counted.

2.5 If your entry includes content you have created, such as a comment, photograph or video, you confirm that it is your own, lawful and not offensive, that it does not infringe anyone’s rights and that it does not show any other person without their permission, and you allow us to re-share it on our social media accounts in connection with the Giveaway, with credit to your account where practicable.

3. THE DRAW AND THE WINNERS

3.1 Winners are selected at random from all valid entries after the closing time, using the random selection service of random.org, and we keep a record of each draw. Unless the Post Details say otherwise, there is 1 (one) winner per Giveaway and no person may win more than 1 (one) prize in the same Giveaway. Before confirming a winner, we check that the entry complies with these Giveaway Terms and the Post Details.

3.2 We notify the winner by publicly tagging or mentioning their account on the same social media account on which the Post was published, and by direct message through the Platform. It is your responsibility to check your messages, including message requests. To claim the prize, the winner must reply to our direct message within 4 (four) hours of the notification, confirming acceptance and providing the information we reasonably need to verify their eligibility and deliver the prize, such as their full name, delivery address, email address or telephone number and, if requested, proof of age and identity.

3.3 If the winner does not reply in time, cannot be contacted, declines the prize, fails verification or has breached these Giveaway Terms or the Post Details, the prize is forfeited and we may select an alternative winner in the same way.

3.4 We only contact winners from the official VillaWin account on which the Post was published, and we never ask for a payment, payment card details or passwords in order to release a prize. Please report any account imitating ours to the Platform and to us.

4. PRIZES

4.1 Each prize is as described in the Post. Prizes are not transferable and cannot be exchanged for cash or for any other prize, and no cash alternative is offered unless the Post Details say otherwise. If, for reasons beyond our reasonable control, we cannot provide the advertised prize, we will provide a substitute of equal or greater value.

4.2 There is no cost to claim or to receive a prize. We deliver or make the prize available free of charge within 30 (thirty) days of confirming the winner, unless a later date is stated in the Post. Where the Post Details state a delivery territory, the winner must provide an address within it, failing which the prize is forfeited and we may select an alternative winner. A prize provided by a third party, such as tickets or an experience, is subject to that third party’s terms, takes place on the date stated in the Post or notified to the winner and does not include travel or other expenses unless the Post Details say otherwise. The winner is responsible for any tax payable on the prize.

5. PUBLICITY

5.1 By entering you agree that, if you win, we will publicly announce the username of your Platform account as described in clause 3.2 and may re-publish or re-share your entry. For 1 (one) month after the closing date, we will make available on request, by email to the address in clause 1.1, information showing that a valid award took place, ordinarily the winner’s surname and county or country of residence. You may object to this when claiming your prize, in which case we may still have to provide your details to the Advertising Standards Authority or another regulator on request.

6. YOUR PERSONAL DATA

6.1 We are the controller of the personal data processed for a Giveaway: your Platform username and public profile information, your entry, your messages with us and, if you win, the details you provide to claim the prize. We use this data to run the Giveaway, to select, verify, announce and contact the winners, to deliver the prizes and to handle complaints. We do so because this is necessary to perform our agreement with you under these Giveaway Terms and to comply with the UK Code of Non-broadcast Advertising and Direct and Promotional Marketing, and because we have a legitimate interest in running fair promotions and preventing fraud. Entering a Giveaway does not sign you up to marketing from us.

6.2 The Platform processes the data you share on it under its own privacy policy, independently of us. We share data with our group companies (including the company that operates our social media accounts on our behalf), with our service providers (such as delivery companies), with the supplier of a third-party prize where necessary, and with regulators or law enforcement where required. We are based in Gibraltar, which the United Kingdom recognises as providing adequate protection for personal data. We keep records of entries and of the draw for 12 (twelve) months after the closing date and the winners’ details for 6 (six) years. You have the rights given to you by data protection law, including to access, correct or delete your data and to object to its processing, which you can exercise by email at dpo@villawin.co.uk, and the right to complain to the Information Commissioner’s Office (ico.org.uk) or to the Gibraltar Regulatory Authority. 7. CHANGES, CANCELLATION AND DISQUALIFICATION

7.1 We may disqualify any entrant and withhold or reclaim any prize where we reasonably believe that they have breached these Giveaway Terms, the Post Details or the rules of the Platform, or have entered by fraudulent or improper means. We will not change the Post Details, and in particular the closing date, after a Giveaway has opened, except for reasons outside our reasonable control and where the change is not unfair to those who have already entered. If a Giveaway cannot run as planned for reasons outside our reasonable control, we may suspend, modify or cancel it, but where valid entries have been received we will still award the prize, or a reasonable equivalent, unless prevented by those reasons. Any change is announced on the same account as the Post.

8. LIABILITY AND LAW

8.1 Nothing in these Giveaway Terms excludes or limits any liability that cannot be excluded or limited by law, or affects your rights as a consumer. Subject to that, we are not responsible for the availability or operation of the Platform, for entries or messages that are lost, delayed or not recorded, for any action taken by the Platform, or for any failure to deliver a prize caused by incorrect information provided by the winner or by events beyond our reasonable control.

8.2 These Giveaway Terms are governed by English law. If you live outside England and Wales, you keep the benefit of any mandatory protections of the law of the place where you live. The version of these Giveaway Terms in force when you enter applies to that Giveaway.
